By accepting these Terms and Conditions of Sale and Use, you declare that you have reached the age of majority in your country, state or province of residence, and that you have given us your consent to allow any minor dependent on you to use this website.

The use of our products for any illegal or unauthorized purpose is prohibited, and you must not, in the context of using the Service, violate the laws of your jurisdiction (including but not limited to copyright laws).

You must not transmit worms, viruses or any other code of a destructive nature.

Any breach or violation of these Terms and Conditions of Sale and Use will result in the immediate termination of your Services.

The website la2l.com is published and operated by SARL la2l whose head office is located at 18 rue Commines 75003 Paris. The General Terms and Conditions of Sale ("GTC") aim to define the conditions under which the sales of products offered by the company la2l via its online store on its website www.la2l.com (hereinafter referred to as "the Website") are made. Any order placed on the Website constitutes the formation of a distance contract, and necessarily implies your acceptance, without restrictions or reservations, of these GTC.

 

Article 2: Product information and availability

2.1 The products sold by la2l on its Website are exclusively reserved for individuals who contract in this capacity with the company la2l. The company la2l presents on its Website the products for sale with the necessary information, in application of article L.111-1 of the Consumer Code, which provides for the possibility for the consumer to know before the final order, the characteristics of the products offered.

2.2 The offers presented by the company la2l are valid only within the limits of available stocks. However, the company la2l provides you with information on the availability of products at the time of your order. Stock status, however, depends on our suppliers. If a product was in fact unavailable after your order, la2l will send you an email as soon as possible to notify you and will then proceed to refund your order thus canceled if your bank account has been debited, under the conditions defined in article 11.

Article 3: Price
Product prices are indicated on the Site in euros (€) including VAT, but excluding customs duties and other taxes.

Prices do not include delivery costs, which are indicated to you during the order process. The company la2l reserves the right to modify its prices at any time, but products are invoiced on the basis of the rates in force at the time of validation of your order. However, any customs duties or other local taxes that may be due, which you must ensure, are your sole responsibility.

 

Article 4: Placing an order
Placing an Order on the Site is subject to compliance with the procedure set up by la2l on the Site, including successive steps leading to the validation of the Order.

The Customer can select as many Products as desired, which will be added to the shopping cart (the "Cart"). The Cart summarizes the Products chosen by the Customer, as well as their prices and associated costs. The Customer can freely modify the Cart before validating the Order. Validation of the Order confirms the Customer's acceptance of the GTC, the Products purchased, their price, and associated costs. 

A confirmation email summarizing the Order (Product(s), price, availability of the Product(s), quantity, etc.) will be sent to the Customer by la2l. To this end, the Customer formally accepts the use of email for confirmation by la2l of the content of their Order. Invoices are available in the "my account" section of the Site.

Article 5: Validation
5.1 Payment for your purchases is made by credit card. The credit cards accepted are as follows: Visa, Mastercard and American Express.
5.2 Products are payable in full upon actual Order. Payment for purchases is made either via Paypal or via the secure platform of our payment provider Stripe.
5.3 In case of refusal of payment by credit card by officially accredited banking institutions, la2l reserves the right to suspend the processing of your order and its delivery, and to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
5.4 Products remain the property of the company la2l until full payment of the price.
5.5 A detailed invoice will be provided to you upon delivery of the purchased products, printable from your customer account.

Article 6: Delivery
Products are delivered to the address you indicate when placing your order. You will receive an email notification of your order shipment, including details of its delivery (delivery address, package number). Delivery is made by making the package available at the address indicated by the customer on the date indicated by the Post Office's control system.

6.1 Delivery times and methods la2l undertakes to deliver ordered products as quickly as possible. The average observed delivery times for available items are 48 to 72 working hours for home delivery in metropolitan FRANCE and 8 to 10 days for Corsica, Monaco, French overseas departments and territories, and international destinations.

However, longer delivery times may be indicated for certain products, which will then be communicated to you during the order process. An email will inform you of any delivery delay.

6.2 You can track your order via your customer account. The tracking number of the package will be communicated to you in the shipping notification email for your order.

6.3 Delivery delay, loss of a package la2L declines all responsibility in the event of delivery delay or loss of a package, as well as regarding the consequences of a delivery delay or loss of a package. Any order not shipped by la2l within thirty (30) days following an order is canceled and refunded, unless otherwise stipulated at the time of order receipt. In the event of partial delivery, this right to refund only concerns products not delivered within an order.

6.4 In the event of impossibility of Delivery, due to an incorrect delivery address or the Customer's failure to collect their Order from the selected pick-up point, no reshipment can be made and the Customer will be refunded within five (5) days from receipt of the Order by la2l.

La2l cannot be held responsible for delivery delays not attributable to it or justified by a case of force majeure.

6.5 In the event of a problem during delivery, particularly product damage, you must notify this difficulty to the carrier and to la2l within twenty-four (24) hours following the delivery of the package. This claim must be reasoned and describe in particular the condition in which the product and its packaging were delivered to you. If possible, we recommend that you examine the package in the presence of the delivery person and have any reservations noted on the delivery slip, of which you must keep a copy. Within forty-eight (48) hours, you must send a copy of your claim to our Customer Service by email. You can then benefit from the exchange and/or refund conditions defined in articles 8 and 11 below.

6.6 International delivery and customs duties For deliveries outside the EU, customs fees may apply according to the legislation of the recipient country. These fees are the responsibility of the customer.

Article 7: Product conformity
A defective product will be replaced by an identical product or, if an identical product is unavailable, will be replaced by a product of equivalent quality and price, unless the product's failure results from misuse or mishandling by the customer or from a modification of the product's characteristics initiated by the customer. If the product's failure is thus attributable to the customer, the product will not be refunded or exchanged and no credit will be granted. If the customer refuses to exchange the defective product for an identical product or a product of equivalent quality and price, la2l will grant them a credit equal to the purchase price and the initially paid shipping costs. If the defective product cannot be repaired or replaced by an identical product or a product of equivalent quality and price, la2l will refund the customer who paid the invoice the purchase price plus the initially paid shipping costs. Any request for exchange based on the defective nature of a product must be addressed by the customer who paid the corresponding invoice to la2l by going to their order tracking page, within eight (8) clear days from the receipt of the defective product. This request must include a precise and complete description of the defect affecting the product sold. To return a product, the customer can also contact Customer Service whose contact details are in article 10 below. However, Customer Service is not authorized to receive returned products. The customer will be notified by email from Customer Service of the acceptance or refusal of the exchange, as well as the principle of issuing a credit or a refund. The definitive nature of this acceptance is however subject to the examination of the defective product returned by the customer, la2l reserving the right to reverse its decision to accept an exchange, a credit or a refund if it turns out that the description of the defect made by the customer does not correspond to the findings made upon receipt by la2l of the returned product or if the product's failure proves to be attributable to the customer. If the subsequent examination of the returned product shows that there is no reason to proceed with an exchange, the issuance of a credit or a refund, Customer Service will inform the customer by email. If the principle of an exchange, the issuance of a credit or a refund is confirmed, the customer must return the defective product to the following address, clearly indicating on the package the return number assigned to them by Customer Service: La2L. Return service (return number) 18 rue Commines 75003 PARIS. The costs of this return will be borne by la2l and will be reimbursed to the customer upon presentation of the corresponding proof. It is up to the customer returning a defective product to obtain proof of reshipment of the goods by their own means. This proof will be either by presenting a registered mail receipt, or by presenting a document provided by a carrier to whom the routing of the returned product has been entrusted. No other mode of proof will be accepted. In the absence of compliance with this return procedure, no action will be taken on an exchange or refund request, la2l declining all responsibility in this regard. Defective products must be returned in their original packaging, accompanied by the defective or damaged parts, any accessories, as well as a legible copy of the invoice. La2l reserves the right to carry out the necessary checks in case of doubt about the conformity of the returned products with the attached invoice and the return number.

Article 8: Legal right of withdrawal (Article L 121-20 of the Consumer Code)

In accordance with Article L.221-18 of the Consumer Code, the non-professional Customer has a period of fourteen (14) days from receipt of the Order to exercise their right of withdrawal with la2l, without having to give reasons for their decision.

The right of withdrawal is exercised without penalty.

The Customer returns the entire Order at their own expense, without undue delay and, at the latest, within fourteen (14) days following the communication of their decision to withdraw in accordance with Article L. 221-21 of the Consumer Code.

Beyond this period of fourteen (14) days, the sale is firm and definitive.

The Product must be returned with a tracking number, in its original packaging, in its original condition, new, unworn.

The refund of the Order by la2l will be made at the latest within fourteen (14) days from the date on which it is informed of the Customer's decision to withdraw.

However, the refund is subject to la2l having been able to recover the Products subject to the return and the refund request.

La2l will make the refund using the same payment method as that used for the payment of the Order, unless the Customer expressly agrees for it to use another. If this payment method has expired, the Customer must contact customer service to modify the refund method so that it does not incur costs for the consumer. LA2l cannot be held responsible for refunds to an expired payment method.

If the Customer fails to comply with these GTC, la2l will not be able to refund the Products concerned. In all cases, return costs are borne by la2l if the Product delivered to the Customer is different from the ordered Product or if it is delivered damaged.

Items from Archive Sales are neither returned, exchanged, nor refunded.

In accordance with articles L.611-1 et seq. of the Consumer Code, the Customer, as a consumer, has the right to free recourse to a consumer mediator for the amicable resolution of any dispute.

Furthermore, in accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an online dispute resolution platform, facilitating the independent out-of-court resolution of online disputes between consumers and professionals in the European Union. Article 9: Legal guarantees

LA2l is only obliged to deliver Products that comply with the contractual provisions. Products are considered to comply with contractual provisions if the following conditions are met: (i) they must conform to the description and possess the characteristics displayed on the Site; (ii) they must be suitable for the purposes for which products of this kind are generally designed; (iii) they must meet the quality and resistance criteria that are generally accepted for products of the same kind and that can reasonably be expected.

Furthermore, la2l guarantees consumers against conformity defects and hidden defects for Products sold on the Site under the following conditions:

All products sold on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 and following of the Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 and following of the Civil Code), allowing the Customer to return defective or non-conforming products free of charge.

Legal guarantee of conformity

Article L217-4 of the Consumer Code: "The seller is required to deliver goods that comply with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions, or installation when the latter was carried out by him under the contract or under his responsibility."

Article L211-5 of the Consumer Code: "To be compliant with the contract, the goods must:

1) Be fit for the purpose ordinarily expected of similar goods and, where applicable:

correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

2) Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller's attention, and accepted by the latter."

Article L211-12 of the Consumer Code: "The action resulting from a lack of conformity is time-barred after two years from the delivery of the goods."

Guarantee against hidden defects

Article 1641 of the Civil Code: "The seller is bound by the guarantee against hidden defects in the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lesser price for it, had he known of them."

Article 1648 of the Civil Code: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for by Article 1642-1, the action must be brought, on pain of forfeiture, within one year following the date on which the seller may be discharged from apparent defects or non-conformities."

Under the legal guarantee for hidden defects, la2l, at the Customer's choice, undertakes, after evaluating the defect, to:

- Either fully refund the price of the returned Product,

- Or partially refund the price of the product if the Customer decides to keep the Product.

Exclusion of warranties

Products modified, repaired, integrated, or added by the Customer are excluded from the warranty. The warranty will not apply to apparent defects. The warranty will not cover Products damaged during transport after delivery or due to improper use.

Terms of implementation of guarantees:
Under the legal guarantee of conformity, the Customer:
(i) benefits from a period of two (2) years from the delivery of the goods to act;
(ii) can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L217-9 of the Consumer Code;
(iii) is exempt from proving the existence of the conformity defect of the goods during the two years.
The legal guarantee of conformity applies independently of any commercial guarantee granted. The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between rescission of the sale or a reduction in the selling price in accordance with Article 1644 of the Civil Code.

Article 10: Personal information

The information and data concerning you are necessary for processing your order and for our commercial relations. This is confidential information that the company la2l cannot transmit to third parties, with the exception of its partners who participate in order processing, as committed to in the privacy policy on our Website. In accordance with the Data Protection Act of January 6, 1978.

The Customer's personal data is kept for the period strictly necessary to achieve the purposes for each of the processing operations envisaged by la2l. The Customer has a right to access, modify, and object to the processing of data concerning them by contacting customer service by email at contact@la2l.com.

Article 11: Errors, inaccuracies and omissions

It may sometimes happen that there is information on our site or in the Service that may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, prices, promotions, offers, product shipping costs, delivery times, and availability. We reserve the right to correct any errors, inaccuracies, omissions, and to change or update information or cancel orders, if any information in the Service or on any associated website is inaccurate, at any time and without prior notice (including after you have placed your order).

We are under no obligation to update, modify, or clarify information in the Service or on any associated website, including but not limited to pricing information, except as required by law. No defined update or refresh date in the Service or on any associated website should be taken to indicate that information in the Service or on any associated website has been modified or updated.

Article 12: Prohibited uses

LA2l, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers and licensors shall not in any case be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
